Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your use of the Salience platform (“Service”), operated by Snowgum Digital Pty Ltd (“we”, “us”, “our”). By creating an account or using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Account Terms
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. One person or legal entity may not maintain more than one active account.
You must be at least 18 years old to use the Service. You are responsible for all activity that occurs under your account.
3. Service Description
Salience is an AI-powered email classification platform. The Service:
- Connects to your Gmail or Outlook email account via OAuth
- Classifies incoming emails into categories you define
- Executes automated actions (labels, notifications, webhooks) based on classification
- Extracts structured data from email attachments (PDFs, images)
- Provides workflow templates for professional services industries
4. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to circumvent usage limits, trial restrictions, or billing controls
- Reverse engineer, decompile, or disassemble the Service
- Share your account credentials with third parties
- Use the Service to send spam, phishing, or unsolicited communications
- Interfere with or disrupt the integrity or performance of the Service
5. Subscription and Billing
Salience offers three tiers: Free ($0/month), Pro ($29/month), and Enterprise (contact us for pricing).
Free trial: New users receive a 14-day Pro trial with full access to all features. No payment details are required. At the end of the trial, your account automatically moves to the Free tier unless you subscribe to Pro.
Billing: Pro subscriptions are billed monthly through Stripe. You may cancel at any time. Cancellation takes effect at the end of the current billing period.
Payment failure: If a payment fails, you have a 7-day grace period during which Pro features remain active. After the grace period, your account is downgraded to the Free tier. No data is deleted during a downgrade.
Pricing changes: We may change our pricing with 30 days notice. Existing subscribers will be notified by email before any price change takes effect.
6. Intellectual Property
Our property: The Service, including its design, code, features, and documentation, is owned by Snowgum Digital Pty Ltd. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described here.
Your data: You retain full ownership of your email data, workflow configurations, and any content you provide to the Service. We claim no ownership over your data.
7. Data and Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your data. By using the Service, you agree to the collection and use of information as described in our Privacy Policy.
8. Email Access and OAuth
To use the Service, you grant Salience OAuth access to your Gmail or Outlook account. This allows us to:
- Read incoming emails for classification purposes
- Apply labels to classified emails (if you configure label actions)
- Create draft replies (if you configure draft reply actions)
You can revoke OAuth access at any time through your Google or Microsoft account settings. Revoking access will stop Salience from processing new emails but will not delete your existing classification history.
Voice Messages (Telegram)
By sending voice messages to the Salience Telegram bot, you consent to the transcription of audio you submit through the Service. Audio is processed in memory and not stored. You are responsible for ensuring you have the right to submit any audio content, including compliance with local recording consent laws. Salience does not monitor or review voice transcripts except as necessary for AI classification.
Document Upload
You may upload documents for AI classification and data extraction. Files are processed in memory and not permanently stored. You retain all rights to uploaded content. You are responsible for ensuring uploaded documents do not contain content that violates these Terms or applicable law. File size and type limits vary by subscription tier.
Webhooks and Messaging
Inbound webhook endpoints and SMS/WhatsApp numbers are provided as part of the Service. You are responsible for the content sent to these endpoints. Salience is not liable for data received from external systems you configure. Rate limits apply per subscription tier. Webhook payloads exceeding 256KB will be rejected.
9. Third-Party Integrations
When you configure action connectors (Slack, Microsoft Teams, Telegram, Google Sheets, Zapier, webhooks, or others), you are directing Salience to share classification data with those third-party services. You are responsible for ensuring your use of those services complies with their terms. Salience is not responsible for the availability, accuracy, or behaviour of third-party services.
10. Service Availability
We use reasonable efforts to keep the Service available and operational. However, we do not guarantee uninterrupted or error-free service. Scheduled maintenance, infrastructure issues, and third-party provider outages may cause temporary disruptions. Enterprise customers may negotiate a separate service level agreement (SLA).
11. Limitation of Liability
The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the maximum extent permitted by law, Snowgum Digital Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months prior to the claim.
12. Termination
You may close your account at any time through the Service settings. We may suspend or terminate your account if you violate these Terms or if your account has been inactive for an extended period.
Upon account deletion, your data is handled as described in our Privacy Policy: all personal data is removed, and only a non-identifiable hashed record is retained.
13. Governing Law
These Terms are governed by the laws of Australia. Any disputes arising from these Terms or the Service will be resolved in the courts of New South Wales, Australia.
14. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we will notify you via email or through the Salience dashboard. Continued use of the Service after changes constitutes acceptance of the updated Terms.
